The aim of this article is to inform about legislation on health risks among healthcare workers, from both public and private sectors. Reviewing the regulation, the existing juridical systems are approached and discussed. Public servants are submitted to the Regime Juridical Unique (RJU) and the private ones to the Work Consolidation Laws (CLT). According to this, public servants should attain to their specific juridical regimen
